Welcome to Scotty AI (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our conversational AI services, websites, applications, and related technologies (collectively, the “Service”).
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms.
PLEASE READ THESE TERMS CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS, INCLUDING A SECTION ON DISPUTE RESOLUTION THAT REQUIRES BINDING ARBITRATION.
Description of service
Our Service provides an interactive, conversational Artificial Intelligence (AI) agent designed for business purposes, including but not limited to:
- Scheduling appointments and demonstrations.
- Facilitating product discovery and providing information.
- Engaging in role-play scenarios for sales, training, and other use cases.
The Service may be accessed globally through various channels, including our website and via SMS/text messaging to United States phone numbers.
User responsibilities & acceptable use
You agree to use the Service in compliance with all applicable laws and regulations. You are solely responsible for your conduct and any data, text, information, and other content (“Content”) that you submit, post, and display on the Service.
Acceptable use policy:
You agree not to misuse the Service or help anyone else to do so. You must not, and must not attempt to, do the following things:
- Use the Service for any illegal, fraudulent, harassing, or harmful purpose.
- Probe, scan, or test the vulnerability of any system or network; breach or otherwise circumvent any security or authentication measures.
- Reverse-engineer, decompile, hack, or “jailbreak” the AI models or the Service.
- Generate or disseminate misinformation, spam, hate speech, or content that is obscene, defamatory, or violates any third party’s rights.
- Use the Service to send unsolicited communications or promotions (spam).
- Violate the privacy of others or distribute their personal information without their express permission.
SMS messaging terms & 10DLC compliance (for U.S. users)
This section applies specifically to users who interact with our Service via SMS/text messaging using a U.S. phone number, in compliance with the Telephone Consumer Protection Act (TCPA) and 10DLC regulations.
Obtaining consent
We will only send you SMS messages after you have provided the appropriate level of consent. You may provide consent through one of the following methods:
- Verbal consent: By giving clear verbal permission to one of our representatives to send you messages for a demo or informational purposes.
- Website chat opt-in: By initiating a conversation on our website where it is clearly disclosed that doing so constitutes your agreement to receive SMS messages and to be bound by these Terms.
- Direct inbound text: By texting our 10DLC number first, you provide implied consent for us to engage in a responsive, conversational exchange.
Consent disclosure
By providing your phone number and opting in, you expressly consent to receive text messages from Scotty AI. You understand and agree that:
- Messages may be sent using automated technology.
- Message frequency for demos is conversational and varies based on your interaction. Message frequency for marketing is occasional and incidental.
- Message and data rates may apply.
- Consent to receive messages is not a condition of any purchase.
- You have read and agree to our Terms of Service (this document) and our Privacy Policy.
How to opt-out
You can cancel the SMS service at any time. To stop receiving messages, text “STOP” to any message you receive from us. After you send the “STOP” message, we will send you a final SMS message to confirm that you have been unsubscribed.

Data privacy & GDPR compliance
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and share your personal information.
As a company based in The Netherlands, we are compliant with the General Data Protection Regulation (GDPR). Our Privacy Policy provides detailed information about your rights under GDPR, including the right to access, rectify, erase, restrict processing of, and port your personal data.
For the purpose of 10DLC compliance, we affirm that:
- The collection of Personally Identifiable Information (PII) may vary depending on the specific service or implementation you are using.
- We do not sell or share your personal information with unaffiliated third parties for their own marketing purposes.
Intellectual property
The Service and its original content, features, and functionality are and will remain the exclusive property of Scotty AI and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
AI disclaimers and limitation of liability
The Service utilizes artificial intelligence, which may produce inaccurate or incomplete information.
“AS-IS” service:
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, express or implied, regarding the accuracy, reliability, or suitability of the information provided by the AI.
No reliance:
You acknowledge that you should not rely on the AI-generated content for medical, legal, financial, or other professional advice. You are responsible for independently verifying any information before making decisions.
Limitation of liability:
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL Scotty AI, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, COVER, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, REVENUE, GOODWILL, USE, OR CONTENT) HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY, INCLUDING, WITHOUT LIMITATION, CONTRACT, TORT, WARRANTY, NEGLIGENCE, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED AS TO THE POSSIBILITY OF SUCH DAMAGES.
Governing law and dispute resolution
Governing law
These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions.
Binding arbitration
Most user concerns can be resolved quickly by contacting us. In the unlikely event that we are unable to resolve a complaint to your satisfaction, you and Scotty AI agree to resolve those disputes through binding arbitration rather than in courts of general jurisdiction. All disputes or claims arising out of or in connection with these Terms shall be finally settled by binding arbitration administered by the Netherlands Arbitration Institute (NAI) in accordance with its Arbitration Rules. The arbitration shall take place in Utrecht, The Netherlands, and the language of the arbitration shall be English.
Class action waiver
You and Scotty AI agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
U.S. regulations
Notwithstanding the foregoing, users interacting with our SMS service in the United States agree to comply with all applicable U.S. laws, including the Telephone Consumer Protection Act (TCPA).
Changes to terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
